South Carolina’s District Court has struck down the same sex marriage ban on grounds that it is unconstitutional.
A U.S. District Court judge has struck down same-sex marriage ban, saying it’s unconstitutional. Judge Richard Gergel gave his ruling on Wednesday in a case brought by two women who tried to get a marriage license in Charleston, S.C.
However marriage licenses cannot be issued since Gergel issued a stay on his order until Nov. 20.Meanwhile according to a spokesman for South Carolina Attorney General Alan Wilson; he will be reviewing the ruling.
The Fourth Circuit Court of Appeals struck down Virginia’s same-sex marriage ban earlier this year and in October the US Supreme Court refused to hear an appeal of the case. Many construed it as a ruling on other states’ gay-marriage laws which come under the ambit of the Fourth Circuit, including South Carolina. South Carolina was the only state in the US which does not allow such marriages.
