Proposition 64 Bound to Legalize Marijuana

October 14, 2016 by Jason Brusse Leave a Comment

Medical marijuana

Proposition 64 will legalize recreational marijuana, but will rise some concerns in the medical industry.

The purpose of Proposition 64 is not only to make recreational marijuana available but also to enhance regulations concerning medical marijuana. Jason Kinney, who is a spokesman who supports Proposition 64, argued that the intention is to enforce medical marijuana. He claimed that the new measures are prone to support the rights of the patients who need to fill their prescriptions. The new rule will not change medical marijuana laws.

  • Some people which have businesses relying on medical marijuana don’t accept Proposition 64.
  • The legalization of recreational marijuana will imply bigger taxes for those who want to develop businesses in this field.

The idea of permitting the use of recreational cannabis in California has created speculations that concern the industry of medical marijuana. Some specialists claim that people will pretend to be patients in need of filling their prescription for medical marijuana, thus avoiding paying higher taxes for the recreational one. These people will have the chance to own more marijuana without being punished for it.

Perhaps some cultivators will become tempted to sell their cannabis on the black market to avoid paying taxes when using the legal way of doing business. The co-author of the proposition which determined California to become the first state which legalized medical marijuana has now some specification to make. He declared himself against Proposition 64 because it distorts the way in which marijuana should be used by people. Its ground purpose is the medical one.

The owner of Wonderland Nursery, Kevin Jodrey grows medical cannabis. He asserted that the approval of Medical Marijuana Regulation and Safety Act was bound to differentiate between the medical market and any other recreational purpose which will appear. The real concern that bothers Jodrey is that the new legislation that will be implemented will allow bigger companies to engulf the smaller businesses of farmers and local people and launch them into the industry of recreational marijuana.

Those who already developed a business in the sector of medical marijuana should be able to decide if they want to remain in that field. He does not want to take part into this new recreational marijuana market because he is skeptical when it comes to high taxes. Jodrey believes that he will lose everything if he uses his business with cannabis for recreational purposes.

Proposition 64 claims that both businesses which rely on recreational cannabis or medical one have to pay an excise tax of 15% and an additional cultivation tax which is based on the product’s weight.
